Hotel use permits on the Costa del Sol: timescales by town hall

One of the factors that most shapes the timetable of a hotel project on the Costa del Sol is not the construction work but the permit. Securing hotel use and the building permit on time makes the difference between opening in the planned season and missing it. We explain what the timescales depend on and how they are managed.

Which permits a hotel requires

A hotel does not need just one authorisation. The process usually involves planning compatibility and hotel use under the local planning framework (the PGOU, the municipality’s general urban plan, or a local by-law), the building permit (new build or renovation), tourism classification by the Junta de Andalucía (the Andalusian regional government) and, finally, the opening and occupancy licence. Each one follows its own procedure and has its own timescale.

What the timescales depend on

The timescale depends above all on the town hall, the type of works (new build versus renovation), how complete the project is and whether hotel use is permitted on that plot from the outset. A well-prepared application, complete and compliant with the regulations from day one, is what shortens the process most: most delays stem from requests for further information caused by incomplete documentation.

Indicative timescales on the Costa del Sol

For reference, permit timescales vary widely between municipalities: at present, as a rough guide, Estepona and Benahavís tend to issue decisions faster than Málaga city or Marbella, with Mijas and Torremolinos somewhere in between. These are ballpark figures that should be confirmed case by case, as they change with the workload of each council’s technical department.

How we handle it at Klic Arquitectos

We handle the permit application ourselves from start to finish: all the back-and-forth with the council’s technical staff is managed directly by us. We know the technical departments of Málaga, Marbella, Estepona, Benahavís, Mijas and Torremolinos personally, which helps us anticipate requests for information and resolve queries before they turn into delays.

Frequently asked questions

How long does it take to obtain a hotel permit on the Costa del Sol?

It depends on the municipality and the type of works. Timescales vary considerably from one town hall to another; a complete application that complies with the regulations is what shortens them most. It is best to estimate them case by case at the start of the project.

Is hotel use permitted on any plot?

No. It must be permitted by the urban planning framework (the PGOU or by-law) for that plot. Checking use compatibility is the first step before buying or designing.

Is tourism classification separate from the building permit?

Yes. Tourism classification is applied for with the Junta de Andalucía and is independent of both the municipal building permit and the opening licence. Both should be planned in parallel.
